DMCA Policy
Game Development Studio Acquisition is committed to respecting the intellectual property rights of others, and we expect our users and the studios we work with to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for reporting alleged copyright infringement and for responding to such claims concerning content hosted on or accessible through our platforms and services, particularly in relation to content developed by acquired studios or related intellectual properties.
We take copyright infringement seriously and will respond to clear notices of alleged infringement that comply with the DMCA and other applicable intellectual property laws.
Filing a DMCA Notice (Takedown Request)
If you are a copyright owner or an agent thereof and believe that any content on our services infringes upon your copyrights, you may submit a written DMCA Takedown Notice to our Designated Copyright Agent. Your notice must include substantially the following:
- Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to allow us to locate the specific work, such as a URL to the original work, a title, or a registration number.
- Identification of the material that is claimed to be infringing: Clearly identify the content you claim is infringing and provide information reasonably sufficient to permit us to locate the material (e.g., URL(s) to the specific page(s) where the material is found on our platform).
- Information reasonably sufficient to permit us to contact you: This includes your name, address, telephone number, and email address.
- A statement that you have a good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature: The physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Please note that under 17 U.S.C. ยง 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
Filing a DMCA Counter-Notification
If you believe that material you posted on our services was removed or disabled by mistake or misidentification, you may file a Counter-Notification with our Designated Copyright Agent. Your Counter-Notification must include substantially the following:
- Identification of the material that has been removed or to which access has been disabled: And the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number: Sufficient contact information to allow us to reach you.
- A statement consenting to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Game Development Studio Acquisition may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid Counter-Notification, we may restore the removed material, unless the copyright owner files an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material.
